Bringing bargaining power to the table – even for smaller claims

This is illustrated by the case of Primrose Matabane*, who was involved in an accident in July 2007 when she was a passenger in a van that was struck from behind by another vehicle. Primrose was pregnant at the time, and the trauma of the accident caused her to give birth prematurely. Fortunately, her newborn baby was unharmed.

Nonetheless, the premature birth and the fact that she suffered whiplash as a result of the accident entitled her to lodge a claim with the Road Accident Fund. Initially, the Fund offered her a pre-trial payout of R35 000. However, thanks to de Broglio’s ace team of attorneys, they managed to negotiate a R117 000 settlement for her – more than three times the initial offer – hours before the matter went to trial.
