Even though his case against the Road Accident Fund (RAF) had been dragging on for years, a Telkom technician managed to secure an interim payment thanks to the attorneys from de Broglio Inc.
Dale Amory (32)* was involved in a car accident in 2001. His case against the RAF finally went to trial in 2007, claiming damages for whiplash and a knee injury.
However, after numerous delays and postponements, the defence was not ready to proceed on the day of the trial – which could have meant that Dale would have to wait even longer before obtaining any financial relief.
Fortunately, the merits of the case had already been settled between the two parties. This meant that his attorneys could apply to the court for him to receive an interim payment from the RAF before the case had been finalised. After the 80-20 apportionment, he was awarded the sum of R250 000.
The case was eventually concluded in late 2009, and Dale was awarded a further R156 000 in addition to the previous payout.
Says Michael de Broglio: “This client had been waiting for many years to have his claim settled and to be able to put his accident behind him for good, and we are pleased that we could assist – particularly by obtaining an interim amount for him while he was waiting for the case to be finalised once and for all.”
