Motorcyclist struck at intersection

Driving motorcycles in South Africa is a risky mode of transport as Hein Strydom* discovered when he was hit by a motor vehicle which was crossing a stop street without seeing him. Motorcycles do not afford the driver, or passenger, the security offered by a motor vehicle which provides a case of protection for its inhabitants. Hein was injured and rushed to hospital by ambulance where he was admitted for a long two weeks. As a result of the accident, Hein suffered multiple fractures and soft tissue injuries. He has undergone numerous painful surgeries and procedures in an attempt to recover his injuries however, his tibia and fibula have not grown back together resulting in a future lifetime of pain, suffering and disability. His life will never be the same as it was before the accident.

Hein was qualified and had been working as a fitter and turner at the time of the accident however he was retrenched after the accident as he was no longer able to perform the physical tasks his job demanded of him. This was a devastating occurrence. Hein lost his job and is now no longer able to support himself and his wife. Due to his age, he is unable to start a new career, he only knew his trade. He applied for a monthly disability grant which he was awarded for one year, however, upon re-application, he was declined further assistance from the government despite the fact that his disability still persisted. The fact that Hein was unable to work again as he had before his injuries sustained from the accident was considered by the legal team at de Broglio Inc and argued that his past and future loss of income formed a vital part of his claim.

They used their expertise to argue with the Road Accident Fund’s legal team the best possible settlement in this particular scenario and even persuaded the court in their favour that Hein is unemployable which all combined in a fantastic cumulative settlement of R2.271 545 million.
