The trauma of being involved in a motor vehicle accident can be exasperated by the daunting thoughts of trying to sue the Road Accident Fund by yourself. Where will you get the money to see the doctors you need to in order for the required medical reports to be completed? How will you pay for representation in court? At de Broglio Inc they outlay the costs of the entire claim including the legal day-to-day costs, the costs of the medico-legal expert appointments which are generally in the thousands of Rands, the costs of Counsel and Senior Counsel, as well as transport and accommodation should their clients not be in a position to afford their own transport. If you have a viable claim, de Broglio Inc can assist you and relieve you of the stress of suing the RAF by yourself.
It was March 2009 when Albert Maqoqa*was on duty as a heavy transport driver travelling from Kroonstad towards Bloemfontein. Another vehicle travelling on the wrong side of the road collided head on with his truck and he lost consciousness upon impact. He was taken to hospital by ambulance where he was admitted for almost one month. He sustained a head injury, and orthopaedic injuries to his legs and right arm.
Albert was a low wage earner, living in a one bedroom house with his four small children on a farm. He had no money for legal fees but wanted to lay a claim against the RAF for his injuries and his losses. He decided to contact de Broglio Inc who assessed the accident and his situation and accepted his instruction as his attorneys. de Broglio Inc immediately began preparing his claim against the RAF, gathering important documents and evidence, and making vital medico-legal appointments for Albert.
His attorney appointed 9 medical experts to consult with him in order to obtain in-depth analyses of his injuries and how they have affected his life and his ability to work. The neuropsychologist s and neurosurgeon appointed by de Broglio Inc investigated his head injury and confirmed that he had sustained a brain injury of a significant magnitude to create long-term problems. The Industrial Psychologist assigned to his case noted that he had been rendered completely unemployable since the accident as he was physically unable to drive again in the future.
With all this medical evidence, and over 3 years of legal preparation, Albert and his legal team from de Broglio Inc made their way to the Pretoria High Court in November 2013, fully prepared to run trial and ensure the best settlement was acquired for him. At court they were met by the RAF’s attorneys. The morning proceeded and the RAF made an offer of R2,509,507.64 which Albert accepted. A tremendous settlement for the man who by no fault of his own, sustained such terrible injuries, that he was no longer able to provide for himself and his young children. Another result from the efforts of the de Broglio Inc legal team which has provided hope and a future for their client.
